Client Found Not Guilty of Assaulting Child

Preparation is key to presenting a good defense.  So is being able to present testimony from expert witnesses, such as doctors, to explain complex issues.

In this case, our client's girlfriend's toddler had abrasions and what appeared to be a black eye.  The local police assumed that our client had caused the injuries and charged him with assaulting the child. 

Experience Makes a Difference

However, a careful review of the evidence and medical records showed that doctors disagreed about the nature of the injury and how it may have been caused. 

The prosecutor called only one of the doctors, who testified that the client must have caused the injury.

NH criminal defense attorney Richard Samdperil called the other doctor, an expert in child abuse cases, to explain that the causes were not clear, and the injuries could have been caused by a sledding accident, as the client had told the police.  

The judge found the client not guilty.
